Terms of Use

By accessing or using the Giving Day portal, including submitting a donation or creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please discontinue use of the portal immediately.

You must be at least 18 years old, or donating with the consent and supervision of a parent or legal guardian, to use this portal. By making a donation, you represent that you have the legal authority and sufficient funds to complete the transaction, including on behalf of any business or organization you represent.

Staff members granted administrative access are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account. Admin access is limited to authorized Foundation personnel and may be revoked at any time for misuse or upon end of employment.

• Use admin tools only for legitimate Foundation business purposes

Donations are processed securely through Square, and by donating you also agree to Square's applicable terms and privacy policies. Recurring donations will be automatically charged on the schedule you select until canceled, and one-time donations are typically non-refundable except as required by law or at the Foundation's discretion.

• Donations are generally tax-deductible to the extent permitted by law; consult your tax advisor
• You will receive an email receipt confirming your contribution

You may designate your gift to a specific fund category or program listed on the portal, and we will make reasonable efforts to honor your designation. However, if a designated fund is fully funded, discontinued, or otherwise unable to use the gift as intended, the Foundation reserves the right to redirect the donation to a similar purpose consistent with our mission.

You agree to use the portal only for lawful purposes and in a manner consistent with the spirit of charitable giving. Honor and memory dedications, anonymous giving options, and public messages must be submitted respectfully and truthfully.

• No fraudulent, harassing, defamatory, or offensive content in messages or dedications
• No use of stolen payment credentials or attempts to circumvent Square's security measures
• No scraping, hacking, or interfering with portal functionality, including the donor wall or leaderboard
• We reserve the right to remove any submitted content or donation record at our discretion

All content on the portal, including the Deep Ellum Foundation name, logo, and design elements, is owned by the Foundation and may not be used without permission. The portal relies on third-party services, including Square for payment processing, and your use of those services is subject to their respective terms.

The portal is provided "as is" without warranties of any kind, and we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Foundation shall not be liable for any indirect, incidental, or consequential damages arising from your use of the portal or any donation transaction.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, and any disputes shall be resolved in the state or federal courts located in Dallas County, Texas. We may update these Terms periodically, and continued use of the portal after changes constitutes acceptance of the revised Terms.
